The legalization of cannabis is a hot topic right now. There are several reasons for this. People and politicians have strong feelings about it. With the presidential elections coming up in 2022, several candidates have already established their positions on cannabis legalization. A/ In short, what is CBD?

CBD stands for cannabidiol, which is just one of hundreds of different natural compounds found in cannabis. It contains almost no THC, so it won't get you high. However, CBD has many potential therapeutic benefits and research is underway to better understand how it can be used to treat issues such as chronic pain, anxiety, insomnia, etc. Overall, the use of CBD is extremely safe and has an excellent safety profile with very few side effects.

B/ What does the State Council say about CBD?

After weeks of tension for the sector and legal jousting, the Council of State has decided to repeal the controversial policy change made by the government last December 30. 


Remember, in France, Neither the fresh flowers nor the raw leaves could be sold. Whether they are alone or associated with other elements. This restriction also applied to the possession of cannabis flowers, which were mainly used to be smoked. In addition, they were sometimes used as a substitute for the ordinary joint or tobacco cigarette.


However, Monday, January 24, 2022, The Council of State has issued a new regulations concerning cannabis in France. The prohibition was decided by the Council of State on a provisional basis.

C/ But, why?


This decision came after the judge of summary proceedings showed an inconsistency with the total ban on CBD. Even, a contradiction.

The main argument concerns the THC (tetrahydrocannabinol) content, the main active molecule of cannabis and the source of psychotropic effects. In the leaves and flowers of CBD, it is less than 0.3%.

Referring to the decree of December 30, it is allowed "to carry out the cultivation, import, export and industrial and commercial use of only varieties of cannabis sativa L. whose content of delta-9-tetrahydrocannabinol (THC) is not higher than 0.3%" But sell to consumers flowers or leaves in the raw state of these same varieties was prohibited.

The State Council came to correct this contradiction by proclaiming:

“ It does not appear that the flowers and leaves of cannabis sativa L. whose THC content is less than 0.3% would present a degree of harmfulness to health justifying a measure of total and absolute prohibition: this threshold is precisely the one used by the contested order itself to characterize the cannabis plants authorized for cultivation, import, export and industrial use. " - Board of state

It is clear that cannabis users in France are leaning toward the left-wing candidate. According to some estimates, nearly 23% of cannabis users will have voted for the party of Jean-Luc Mélenchon. It is important to note that these people represent one-tenth of the French population.


The position of the leader of France insoumise is not new. Indeed, during the 2017 presidential campaign, he was already in favor of the legalization of Cannabis. In 2022, he comes to support this position by saying: "Yes, this is what we must do, the rest has failed. I am a pragmatist in this area, we do what works. Prohibition has not given anything" on  RMC. His objective is that the French State supervises the chain of production, consumption, and sale of Cannabis to make it a public state monopoly. 


Jean-Luc Mélenchon thinks that the police controls in this field are a waste of time for the police officers. That is to say 60% of the police contact operations are made to check if the controlled persons are cannabis holders or not.

 Emmanuel Macron against legalization

The re-elected President Emmanuel Macron holds a very special position regarding the legalization of Cannabis.  He is against increasing criminal penalties for traffickers as the right-wing parties would like to do. However, he is against legalizing cannabis in France. He wishes to hire a more efficient police or gendarmerie to manage these traffics.


During his presidential campaign in March 2022, he stated that he does not support the legalization of cannabis in France. The new President recently stated that "narcotics need a brake, not a publicity stunt". He also added that the liberalization of cannabis consumption could lead consumers to other forms of crime.

 Marine Le Pen for a reinforcement of the forces of order

Marine Le Pen says she is totally against the legalization of cannabis, but for the legalization of therapeutic cannabis. This is what the presidential candidate said in the program France dans les yeux On BFMTV.


The flag bearer of the National Rally thinks that the legalization of cannabis does not reduce the traffic of these drugs. She joins Emmanuel Macron on the fact that a cannabis trafficker will be tempted to move to other forms of drugs.

Finally, she thinks to reinforce the police forces and the police units, in order to fight against the delinquents.

It should be noted that Marine Le Pen does not target the therapeutic or pharmaceutical field, but only the delinquents and drug dealers. It is very important to make the nuance between the different cases of use of Cannabis and its derivatives.

 Éric Zemmour: For a reinforcement of the sanctions before a legalization in case of failure

Concerning his policy on the subject of cannabis, the right-wing candidate is also rather concise. The plant is again linked to drug trafficking, which Eric Zemmour wishes to eradicate from French soil. To achieve this, the leader of the Reconquest party wants to set up a national force composed of police and justice services, customs and tax administrations to block the traffickers.


To be clearer, Eric Zemmour wants to start by adopting a severe policy against drug trafficking. However, in case of obvious failure, he will consider other measures to be taken. 

What future for cannabis with Emmanuel Macron?

Many people confuse cannabis and its derivatives, for example, CBD. The difference between cannabis and CBD is that the latter contains less than 0.3% THC, the main psychoactive component of cannabis.
